RESOLUTION NO. 48-25
RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF MORRO BAY, CALIFORNIA
APPOINTING BRIAN STACK AS CITY ATTORNEY AND
APPROVING A CITY ATTORNEY EMPLOYMENT AGREEMENT
BETWEEN THE CITY OF MORRO BAY
AND BRIAN STACK
T H E C I T Y C O U N C I L
City of Morro Bay, California
WHEREAS, Morro Bay Municipal Code section 2.16.070 creates and establishes the
office of the City Attorney and provides that the City Attorney shall be appointed by the City
Council wholly on the basis of their administrative and executive ability and qualifications and
shall hold office for and during the pleasure of the City Council; and
WHEREAS, the City Council has been actively recruiting for the City Attorney position;
and
WHEREAS, as a result of this active search and recruitment, the City has identified Brian
Stack, who possesses the experience, qualifications, knowledge, skills, and abilities to serve as
the permanent City Attorney; and
WHEREAS, pursuant to California Government Code Section 34851, the City Council
shall fix the compensation of all appointive officers and employees by resolution and such officers
and employees shall hold office at the pleasure of the City Council; and
WHEREAS, the City Attorney shall receive such salary and benefits as set forth in an
employment agreement between the City Council and City Attorney which shall be approved by
this resolution.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MORRO BAY DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. The City Council finds that the above recitals are true and correct and,
accordingly, are incorporated herein as findings and a material part of this Resolution.
Section 2. Brian Stack is hereby appointed as the City Attorney of the City of Morro
Bay beginning August 18, 2025.
Section 3. The City Attorney Employment Agreement between the City of Morro Bay
and Brian Stack, a copy of which is attached hereto as an attachment, is approved.
Section 4. The Mayor is authorized to execute the City Attorney Employment
Agreement on behalf of the City subject to Interim City Attorney approval as to form.

Section 5. This Resolution shall immediately take effect upon passage.
PASSED AND ADOPTED by the City Council of the City of Morro Bay California at a regular
meeting held on 12th day of August 2025 on the following vote:
AYES: Wixom, Eckles, Edwards, Landrum, Luffee
NOES: None
