ROLL CALL CITY COUNCIL INTERVIEW OF APPLICANTS FOR STREET ADVISORY COMMITTEE RECREATION HALL - 7:00 P.M. ROLL CALL PUBLIC COMMENT PERIOD - Members of the audience wishing to address the Council on matters other than scheduled hearing items may do so when recognized by the Mayor, by standing and stating their name and address. Comments should normally be limited to three minutes. NEW BUSINESS D-6 COUNCIL DISCUSSION OF "VRM" PROPERTY AND CONSIDERATION OF INTERIM URGENCY ZONING ORDINANCE ADJOURNMENT MINUTES - MORRO BAY CITY COUNCIL ADJOURNED REGULAR MEETING - FEBRUARY 11, 1987 CITY HALL CONFERENCE ROOM - 5:30 P.M. Mayor Reddell called the meeting to order at 5:35 p.m. ROLL CALL PRESENT: Dale Reddell Mayor John Lemons Councilmember Jeff Odell Councilmember Rose Marie Sheetz Councilmember ABSENT: Jim Miller Councilmember Council interviewed the following people for positions on the Street Advisory Committee: Ross Blakely, Stephen Paul, Len Charpentier, Paul Donnelly, Al Jorge, and Bill Tyler. Councilmember Miller arrived at 6:30 p.m. Councilmember discussed the various candidates. MOTION: Councilmember Sheetz moved Council select the following as members of the Committee: Al Jorge, Bill Tyler, Paul Donnelly, Thomas Dougherty, and Stephen Paul. The motion was seconded by Councilmember Odell and unani- mously carried. (5-0) MOTION: Councilmember Sheetz moved Council adjourn and continue to the Recreation Hall for the 7:00 p.m. adjourned meeting. The motion was seconded by Councilmember Odell and unanimously carried. Mayor Reddell called the meeting to order at 7:00 p.m. ,PnT.T. C'AT.T. PRESENT: Dale Reddell John Lemons Jim Miller Jeff Odell Rose Marie Sheetz ABSENT: STAFF: PUBLIC COMMENT None Gary Napper Judy Skousen Bill Farrel Elane Novak Mayor Councilmember Councilmember Councilmember Councilmember City Administrator City Attorney Comm. Development Dir. Deputy City Clerk Dick Brewer of Los Angeles, representing the owners of "VRM Pro- perty" (property north of the High School), explained the steps the owners had taken to reach this point. He said they will be submitting a Coastal Permit application soon. Mr. Brewer commended the City Council and staff for their respon- siveness. He stated the owners of the property hoped to hold public meetings after they established the conceptual ideas and later when they had their Coastal Permit. He praised Bill Farrel for assisting them in obtaining all the necessary information to submit the Coastal application. The permit will be submitted on a "basic concept", and he will ask for an extension of 30-60 days after application to meet with the citizens and other interested parties in the community. He also explained he felt it would take two to three years to go through the complete process to substantiate use, and then proceed to subdivision maps and con- struction permits. At this time, the owners are interested in single family residences for the property. Mr. Brewer does not believe this interim ordinance is necessary and feels the City has all the protection it needs in the Coastal Land Use Plan. He said the contemplated uses for the land are already known. Mr. Warren Dorn stated there were other properties involved here as indicated on the proposed map. He thought they were all in the Environmentally Sensitive Habitat zone; and, if they weren't, they should all be so zoned and become part of a "safe area" as historically and nature -wise they should be left for all to use MINUTES - MORRO BAY CITY COUNCIL ADJOURNED REGULAR MEETING - FEBRUARY 11, 1987 PAGE TWO and enjoy. He also said the land in question is part of a flood plain and it would not be cost effective to construct housing in this area. Bea Rohan agreed with Mr. Dorn; she said she has viewed the area when it has been flooded due to high tides and it will not make a good construction site. NEW BUSINESS D-6 COUNCIL DISCUSSION OF "VRM" PROPERTY AND CONSIDERATION OF INTERIM URGENCY ZONING ORDINANCE Mr. Napper commented briefly on the subject. He mentioned some small changes to the proposed ordinance and pointed out where each change was located. He explained the "VRM" land as well as other lands outlined in map attached to the ordinance should be studied. He said the City and the School District have facili- ties in the area, and these public buildings will be exempted from the study. After the study is completed, the findings will be presented to City Council. Councilmember Miller asked why the ordinance is needed; the only reason he could see was to stop the project. He asked if the permit to the Coastal Commission could be submitted during the time the ordinance is in effect. Bill Farrell indicated the permit could be submitted; the time cited by the ordinance would be to permit study of the properties for best zoning. Mayor Reddell advised Councilmember Miller the ordinance was not suggested by staff but rather at his request to allow Council time to study the lands in question. Councilmember Lemons commented if the ordinance is not passed, the VRM properties could submit an application preserving the current zoning. He believed it is imperative Council adopt the ordinance as the Local Coastal Plan has to be reviewed every five years. Ms. Skousen supported Councilmember Lemons' statement that if an application is filed with all necessary documents, applicants "vest" with the zoning in effect at that time. Mr. Brewer did not agree with Ms. Skousen; he said the Coastal Plan is a "living document" which is constantly changing and their only right was to submit their application. MINUTES - MORRO BAY CITY COUNCIL ADJOURNED REGULAR MEETING - FEBRUARY 11, 1987 PAGE THREE Councilmember Sheetz agreed with Councilmember Lemons but won- dered if the interim ordinance would hold up the VRM property owners in any way. Bill Farrel said it would not, they could go ahead and submit their Coastal application, it would just allow the City time to study the uses for the land. Council asked City Attorney Judy Skousen if their intentions to pass the ordinance would expose the City to litigation. Ms. Skousen said she could not assure them a lawsuit would not occur, but believed they were on safe ground as the LCP has to be re- viewed every five years. MOTION: Councilmember Lemons moved Ordinance No. 301 be read be title and number only. The motion was seconded by Councilmember Odell and unanimously carried by roll call vote. (5-0) Mr. Napper read Ordinance No. 301 by title and number only; an Ordinance Adopting an Interim Urgency Zoning Measure Which Will Take Effect Immediately Upon Its Adoption, and Which Will Tem- porarily Prohibit Development on Certain Land Area in the City. MOTION: Councilmember Lemons moved Ordinance No. 301 be enacted as an urgency zoning measure. The motion was seconded by Councilmember Sheetz and unanimously carried. (5-0) ADJOURNMENT MOTION: Councilmember Sheetz moved the meeting be adjourned. The motion was seconded by Councilmember Odell and unanimously carried.
