Mayor Reddell called the meeting to order at 7:04 p.m.

1. Mary Phillips stated Council needs to set a precedent
as to whether the people have the right to vote on City Coun-
cilmembers. She said last time Council had the option of ap-
pointing to fill an unexpired term, they appointed Ray Kaltenbach
who was the Council candidate receiving the next highest number
of votes in the recent election. The person who received the
next highest vote in the most recent election (November 1986) was
"B" Rohan, and Mrs. Phillips believed Council should follow the
same procedure and appoint Ms. Rohan to the vacancy.
Councilmember Lemons commented the Civic Action League had pre-
sented Council with a letter along similar lines. He wished to
remind the citizens of the time in 1978 when the people who wrote
this letter supported 4 candidates who were elected to office.
At that time, they also had the same opportunity this Council
has; to appoint someone to an unexpired term, or hold a special
election. One of the newly -elected members proposed Council ap-
point the person who received the next highest number of votes in
the election, who happened to be John Lemons. That same Council
then appointed someone entirely different. Several months later,
they had the same opportunity as their appointee resigned because
of moving away. They again appointed someone they wanted rather
than someone who had run for office and received a significant
number of votes.
He said this Council by law has the right to appoint anyone they
choose. Additionally there is no indication any of the people in
the most recent election received a majority of the votes. There
is nothing wrong with Council proceeding as they are, and it is
no reflection on "B" Rohan.

Councilmember Lemons reminded Councilmembers they should not only
think of the people who voted for them when considering their
obligation to choose a Councilmember; they must also consider the
entire community and attempt to secure someone with the qualifi-
cations and talent which would go the furthest to making a Coun-
cil which is cooperative.
MOTION: Councilmember Lemons moved Council appoint Tom Wuriu to
fill the Council vacancy. The motion was seconded by
Mayor Reddell and failed on the following roll call
vote:
AYES: Lemons, Reddell
NOES: Odell, Sheetz
MOTION: Councilmember Lemons moved Council appoint John Baker
to fill the Council vacancy.
The motion died for lack of a second.
Mayor Reddell suggested Sylvia Cook, noting she is a long time
resident, retired from business in Morro Bay.
MOTION: Mayor Reddell moved Sylvia Cook be appointed to the
Council vacancy. The motion was seconded by Coun-
cilmember Lemons.
There was further discussion on the motion.
Mayor Reddell withdrew his motion, and Councilmember
Lemons his second.
Mayor Reddell stated he wished to discuss other nominees before
he made a specific motion.
Councilmember Odell suggested several names for Council consider-
ation: Jack Harper, Bernard Melvin, Jim Hartzell, Dr. Tom
Cahill, Imogene Haidet, Bruce Elster, Geoff Moreland, and Jim
Olson. He reminded Council they have until August 31st to ap-
point, and there is a lot to consider. He has only talked to
Bruce Elster who said he would accept the appointment if offered.
However, Mr. Elster might have a conflict of interest in that he
is the engineering agent for the Williams Brothers shopping cen-
ter project.
Mayor Reddell stated he would be hesitant to appoint someone who
is the agent for the largest development in the City.
Councilmember Sheetz stated she contacted 3 individuals, and they
were not willing to accept appointment. She suggested Coun-

cilmembers contact some of the people mentioned this evening and
make a decision at a later date. Councilmember Lemons stated he
thought that's what Councilmembers were supposed to do between
Monday night and tonight; he said it is counterproductive to con-
sider people when Council doesn't know if they would be willing
to serve or not.
MOTION: Mayor Reddell moved Sylvia Cook be appointed to the
Council vacancy. The motion was seconded by Coun-
cilmember Lemons.
Councilmember Odell objected to the inference if he wasn't pre-
pared to make a decision this evening, he wasn't fulfilling his
obligations. He said he has until August 31st to make a deci-
sion, and wants more time to meet with suggested candidates.
Councilmember Lemons said we need a 5th councilmember, and we've
had more than 12 days to consider this.
There was considerable discussion.
Mayor Reddell withdrew his motion and Councilmember
Lemons his second.
Councilmembers concluded they were not going to receive a major-
ity vote on any candidate, and directed this matter be placed on
the agenda for the next regular meeting, August 24th. The item
regarding selection of Mayor Pro Tem and appointments to inter-
governmental boards would also be rescheduled at that time.
D-2 SELECTION OF MAYOR PRO TEM, AND APPOINTMENTS TO INTER-
GOVERNMENTAL BOARDS
Deferred to August 24th meeting.
E. CLOSED SESSION
MOTION: Councilmember Sheetz moved the meeting adjourn to
Closed Session. The motion was seconded by Councilmem-
ber Lemons and unanimously carried. (4-0)
Mayor Reddell announced Council is adjourning to Closed Session
to discuss City -initiated litigation in accordance with Govern-
ment Code Section 54956.9(c); and pending litigation in accor-
dance with Government Code Section 54956.9(a) in the matters of
Western Oil and Gas Assoc. vs. Sonoma County, et al, and Key-ota-
Morro Bay, Inc. and Morro Bay -Natalie, Inc. vs. City of Morro
pay -
The meeting adjourned to Closed Session at 7:48 p.m. and returned
to regular session at 9:02 p.m.

The motion was seconded by Councilmember Sheetz and
unanimously carried. (4-0)
The meeting adjourned at 9:02 p.m.
