RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF MORRO BAY, CALIFORNIA,
DECLARING THE CITY’S INTENTION TO ANNEX LOTS 1 THROUGH 5 OF TRACT 2859
INTO THE CLOISTERS LANDSCAPING AND LIGHTING MAINTENANCE ASSESSMENT
DISTRICT

WHEREAS, the City Council of the City of Morro Bay, California has previously conducted
proceedings to establish the Cloisters Landscaping and Lighting Maintenance Assessment
District (LLMAD) pursuant to the terms and provisions of the Landscaping and Lighting Act of
1972 (Streets and Highways Code sections 22500 et. seq.) (the "Act"), to fund the maintenance
of the Cloisters Park and Open Space; and
WHEREAS, Lot 124 of the original Cloisters subdivision (Tract 1996) was originally
dedicated to the City of Morro Bay for future use as a fire station and excluded from the LLMAD;
and
WHEREAS, Lot 124 has subsequently been sold by the City to a private developer and
subdivided into five residential lots, recorded as Tract 2859 in December 2025; and
WHEREAS, the City Council has received a petition from the landowner requesting that it
annex into the LLMAD, and the City Council now desires to commence proceedings to annex
territory into the LLMAD as described herein; and
WHEREAS, under the Act, this City Council, as the legislative body for the Cloisters
LLMAD, is empowered with the authority to annex territory into the LLMAD.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Morro Bay,
Section 1. Recitals. The above recitals are true and correct.
Section 2. Public Convenience and Necessity. This City Council hereby determines
that the public convenience and necessity requires that territory by annexed into the Cloisters
Landscaping and Lighting Maintenance Assessment District in order to pay the costs and
expenses for the required and authorized public services.
Section 3. Boundaries. A general description of the territory included in the existing
Cloisters LLMAD is hereinafter described as follows: Lots 1 through 120 of Tract 1996, recorded
in Book 17 of Maps, at Page 83, and as more particularly described in the Covenants, Conditions
and Restrictions for Tract 1996 recorded as Document Number 1996050337 at the Office of the
Recorder of San Luis Obispo County.
A description of the boundaries and territory proposed to be annexed is as follows: Lots 1 through
5 of Tract 2859, recorded in Book 44 of Maps, at Page 25 at the Office of the Recorder of San
Luis Obispo County.
Section 4. Services. The improvements to be maintained are the Cloisters Park and
Open Space areas, more particularly described in Resolution 68-96 of the City Council, dated
September 9, 1996.
Section 5. Public Hearing. Notice is given that on Tuesday, June 23, 2026, at 5:30
p.m. or as soon thereafter as the matter may be heard, in the regular meeting place of this City
Council at the Veterans Hall, 209 Surf Street in the City of Morro Bay, and the same are hereby
appointed and fixed as the time and place when and where this City Council, as legislative body
for the Cloisters LLMAD, will conduct a public hearing on the annexation of territory to the Cloisters
LLMAD, and consider and finally determine whether the public interest, convenience and
necessity require said annexation of territory to the Cloisters LLMAD and the levy of said special
assessment therein.
Section 6. Notice. The City Clerk is hereby directed to cause notice of said public
hearing to be given by publication one time in a newspaper of general circulation in the area of
the Cloisters LLMAD, including the area to be annexed to the LLMAD. The publication of notice
shall be completed at least seven days before the date herein set for said hearing. The City Clerk
may also cause a copy of such notice to be mailed to the registered voters and landowners within
the territory proposed to be annexed, which shall be mailed at least fifteen days before the date
of said hearing.

held on this 12th day of May, 2026, by the following roll call vote:
